The Reasons for Changing Sex in the View of Fiqh are Haram According to Gus Baha

In one of his lectures, Gus Baha explained the reasons for the prohibition of changing sex, from male to female and vice versa. The excuse of people changing their genitals on the basis of human rights is unacceptable. Because in the fiqh review there will be many complicated problems that are impossible to solve and find solutions for.

KH. Bahauddin Nur Salim or better known as Gus Baha then questioned the jurisprudence law on people who change sex (male to female). After the person changes gender, then who should he sleep with? How do you pray? and also he should marry Who? These questions will continue, along with the rejection of jurisprudence and also the medical against the perpetrators of sex change. Because, all of his body systems still function as male, not female.

People who change into a vagina can not necessarily be sentenced to women. the chromosome system in his body still functions as a male, he will not menstruate, his beard is still growing, his interest is still in women, and his social style is still male, not female. This is highly criticized by the Qur'an as Allah says in the Qur'an Surah an-Nisa verses 117-119,

فَلَيُغَيِّرُنَّ خَلْقَ اللَّهِ

Imam Shafi'i explained that there are two kinds of knowledge, namely, jurisprudence and medicine.

إنما العلم علمان: علم الدين، وعلم الدنيا، فالعلم الذي للدين هو: الفقه، والعلم الذي للدنيا هو: الطب

"There are two kinds of knowledge: the science of religion and the science of the world, the science of religion, namely fiqh (fiqh akbar: aqidah, fiqh ashgar: fiqh of worship and muamalah, pent). While the science for the world is medical science.”
